A Field Sobriety Test (FST) is a series of physical and cognitive exercises used by law enforcement officers to assess a person’s level of impairment by alcohol or drugs during a traffic stop. FSTs are typically administered roadside, and their purpose is to help officers determine if there is probable cause to make an arrest for driving under the influence (DUI) or driving while intoxicated (DWI).

Common Field Sobriety Tests include:

Horizontal Gaze Nystagmus (HGN): This test involves the officer observing the driver’s eyes as they follow a slowly moving object, such as a pen or flashlight. Nystagmus, an involuntary jerking of the eyes, can be more pronounced in individuals under the influence.

Walk-and-Turn (WAT): In this test, the driver is asked to take a certain number of steps along a straight line, turn, and return in the opposite direction. The officer looks for signs of impairment, such as difficulty maintaining balance, using arms for balance, or stepping off the line.

One-Leg Stand (OLS): The driver is instructed to stand on one leg while counting aloud. The officer assesses the driver’s ability to maintain balance and perform the task as instructed.

Finger-to-Nose Test: The driver is asked to touch their nose with the index finger, either with eyes closed or with head tilted back. The officer looks for signs of unsteadiness or difficulty with coordination.

Alphabet or Counting Tests: These tests involve cognitive tasks, such as reciting the alphabet or counting backward. The officer assesses the driver’s ability to follow instructions, concentrate, and perform the task accurately.

It’s important to note that FSTs are not foolproof, and various factors, including medical conditions, fatigue, or nervousness, can affect an individual’s performance. Furthermore, the subjective nature of these tests can lead to challenges in court.

If a driver performs poorly on FSTs or if the officer believes there is reasonable suspicion of impairment, they may proceed to conduct chemical tests, such as a breathalyzer test or blood test, to measure the driver’s blood alcohol concentration (BAC).

Individuals who are subjected to FSTs have the right to refuse them, but refusal may have legal consequences, such as the suspension of a driver’s license. It’s advisable for individuals to understand their rights and seek legal advice if facing DUI or DWI charges.
