Texas takes underage drinking and driving very seriously - if you are caught driving with a blood alcohol level of .08% or higher you will be charged with Driving While Intoxicated (DWI); if you are under the age of 21 and are caught driving with any detectable amount of alcohol, you will be charged with Driving Under the Influence (DUI).

The good news for minors convicted of drinking under the influence (D.U.I.) the first time, is that there will be no jail sentence. However, there are other significant penalties, including a fine and probation, and the possibility of community service and alcohol awareness classes. The minor's driver's license will also be suspended.

If a minor is caught driving again after consuming any detectable amount of alcohol, the consequences will be much more severe.
