The Uses and Misuses of Field Sobriety Tests

A police officer who suspects someone of driving while intoxicated commonly administers three standardized field sobriety tests:

  • Walk and Turn
  • One Leg Stand
  • Horizontal Gaze Nystagmus (HGN)

In addition, suspects are commonly asked to blow into a portable breath test (PBT).

If a person has been asked to do these tests, the officer has almost certainly decided to make an arrest, and is seeking additional evidence to strengthen the case.

It is important to remember that these tests have some fatal flaws. Even completely sober people often fail them for reasons totally unrelated to alcohol consumption. For example, if you have problems with balance you will likely fail. Arthritis can make standing on one leg and turning difficult or impossible. Your nervousness and anxiety at being on the side of the road and under possible threat arrest can affect your performance and even make your perform worse.
